INEC Faces Legal Challenge: ADC vs. David Mark

The National Working Committee (NWC) of the African Democratic Congress (ADC), led by Nafiu Bala Gombe, has expressed its disapproval of the Independent National Electoral Commission (INEC) for what it termed a “premature and biased” acknowledgment of the faction led by David Mark, despite an ongoing court case that questions its legitimacy.

In a statement released following an emergency joint meeting of the NWC and the National Executive Committee (NEC) on Saturday in Abuja, the party accused INEC of compromising its leadership structure and jeopardizing the foundation of democracy in Nigeria.

The ADC, under the leadership of its National Chairman Gombe, stated that INEC’s action to feature the Mark leadership on its official website “raises significant questions regarding the commission’s neutrality and credibility.”

While urging its members to maintain calm and unity, the party emphasized that it would not permit its platform to be seized by “idle politicians” seeking to advance their own ambitions.

According to the statement, “The ADC members convened in response to INEC’s hasty recognition and posting of the David Mark-led leadership of the party on its official portal, despite a pending legal challenge to the legitimacy of this leadership.

“This action raises serious concerns about INEC’s impartiality and its dedication to uphold the democratic principles enshrined in our constitution. The ADC strongly condemns this premature action and demands an immediate correction, asserting that we will not passively observe as our party’s legitimacy is compromised.

INEC, as the guardian of our electoral integrity, is anticipated to uphold a neutral position in all political affairs. Nevertheless, recent actions indicate a concerning deviation from this expectation. By appearing to align itself with individuals who have previously undermined their own political organizations, INEC risks being viewed as partial.

The ADC acknowledges that these individuals, in their frantic pursuit of power, have resorted to manipulative strategies, aiming to exploit our party for their own benefit. This conduct not only jeopardizes the democratic process but also represents a significant threat to the stability of our nation.

Historical Instances of Division. The strategies utilized by these opportunistic politicians are not unprecedented; they resonate with the divisive tactics observed during President Goodluck Jonathan’s tenure.

By capitalizing on regional sentiments and inciting discord, they have caused considerable harm to Nigeria’s political environment. The consequences of their actions are severe, resulting in a stagnation of progress that has regressed our nation by decades.

According to the ADC, such divisions and opportunism have played a role in Nigeria’s ongoing economic decline, insecurity, and deep-rooted corruption, which continue to undermine public confidence in governance.

The party has confirmed that it has initiated legal proceedings at the Federal High Court against INEC and those it refers to as “desperate politicians,” seeking to annul the recognition and restore the party’s mandate.

Additionally, it has urged the electoral authority to “exercise maturity and restraint” by waiting for the outcome of the case before making any further statements regarding the ADC leadership.

In light of INEC’s unjust actions, the ADC has initiated legal proceedings against the Commission and specific individuals at the Federal High Court.

The party stated, “This litigation is intended to contest the validity of INEC’s recent actions and seeks redress for the damage caused to our party. We urge INEC to demonstrate maturity and restraint by waiting for the outcome of this ongoing court case before making any further announcements concerning party leadership on its official platform.

“The ADC places a high priority on peace and stability within its ranks and is dedicated to avoiding any actions that could result in confusion or unrest among our members. We are a well-organized party, founded on clear principles and values.
